Terms of Use — AI Chavrusa

These Terms of Use ("Terms") are an agreement between you and Oriel Hagbi, an individual ("AI Chavrusa," "we," "us") governing your use of the AI Chavrusa website and service at aichavrusa.org (the "Service"). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

PLEASE READ SECTIONS 7 (AI CONTENT), 10 (DISCLAIMERS), 11 (LIMITATION OF LIABILITY), AND 14 (DISPUTES) CAREFULLY. THEY LIMIT OUR RESPONSIBILITY AND AFFECT HOW DISPUTES ARE RESOLVED.

1. The Service

AI Chavrusa is a free, non-commercial, AI-assisted Torah and Talmud study tool. It presents source texts and an AI "teacher," powered by Google's Gemini models, that explains them and answers questions. There are no paid plans or paid features.

2. Eligibility

You may use the Service only if (a) you are at least 18 years old, (b) you are located in the United States while using it, and (c) you are able to form a binding contract. By using the Service you represent that all three are true. You may not use a VPN, proxy, or other method to access the Service from outside the United States or to get around our access controls. We may block access from outside the United States and may suspend any account we reasonably believe does not meet these requirements.

3. Your account

Provide accurate information and keep your password confidential. You are responsible for activity on your account. One account per person. Tell us promptly at the contact address in Section 17 if you believe your account has been compromised.

4. Free capacity and availability

The Service runs on limited free computing allowances. Daily limits apply per account and across all users; when capacity is used up, study features pause until the daily reset. We may change, limit, suspend, or discontinue all or part of the Service at any time, with or without notice. If we plan to shut down the Service permanently, we will try to give at least 30 days' notice by email or in the app so you can request a copy of your data.

Use the Service only for lawful, personal, non-commercial study. You agree not to:

6. Your content

You keep whatever rights you have in the messages you type ("Your Content"). You grant us a non-exclusive, royalty-free, worldwide license to host, store, process, and transmit Your Content (including sending it to Google as described in our Privacy Policy) only as needed to operate, secure, and improve the Service and comply with law. This license ends when Your Content is deleted from our systems, except as described in our Privacy Policy's retention section. You are responsible for Your Content and confirm you have the right to submit it.

Source texts come from public-domain and openly licensed sources. Each passage displays its source edition and license, and that license governs the text. In particular:

Texts are provided by their licensors "as is"; the licensors make no warranties and do not endorse AI Chavrusa. The Creative Commons licenses do not grant you any rights in AI Chavrusa's software, design, or AI outputs beyond what the license itself grants for the licensed text.

10. Disclaimer of warranties

THE SERVICE, INCLUDING ALL TEXTS, TRANSLATIONS, AND AI-GENERATED CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT YOUR DATA WILL NOT BE LOST. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AI CHAVRUSA AND ITS OPERATOR AND VOLUNTEERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO THE SERVICE, ANY CONTENT (INCLUDING AI-GENERATED CONTENT AND ANY RELIANCE ON IT FOR RELIGIOUS, LEGAL, OR OTHER DECISIONS), OR THESE TERMS — WHETHER BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED FIFTY U.S. DOLLARS (US $50). THIS LIMITATION APPLIES TO CLAIMS ARISING FROM OUR OWN NEGLIGENCE, BUT DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (FOR EXAMPLE, FOR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE WHERE THE LAW SO PROVIDES). You acknowledge that the Service is offered free of charge and that these limitations are a fair allocation of risk without which we would not offer it.

You agree to defend, indemnify, and hold harmless AI Chavrusa and its operator from claims, losses, and expenses (including reasonable attorneys' fees) by a third party arising from your violation of these Terms, your misuse of the Service, or Your Content.

13. Termination

You may stop using the Service and request account deletion at any time (see the Privacy Policy). We may suspend or terminate your access at any time if you violate these Terms, if required by law, or if we discontinue the Service. Sections 6 (license, to the extent needed for retention), 7, 8, 10, 11, 12, 14, and 16 survive termination.

If you believe material on the Service infringes your copyright, email us at the address in Section 17 with: identification of the work, the location of the material on the Service, your contact information, a statement that you have a good-faith belief the use is not authorized, a statement that your notice is accurate, and your physical or electronic signature. We will review and remove material where appropriate. We have not registered a designated agent with the U.S. Copyright Office; send copyright complaints to the contact email in Section 17.

16. General

Changes to these Terms. We may update these Terms. We will post the updated Terms with a new "Last updated" date and, for material changes, notify you by email or a prominent in-app notice at least 14 days before they take effect. Changes do not apply to disputes that arose before the change. If you continue to use the Service after changes take effect, you accept them; if you do not agree, stop using the Service and you may delete your account.
Entire agreement; severability; no waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the rest remains in effect. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms. We may assign them to a successor operator (for example, an LLC or nonprofit formed to run the Service) with notice to you.
Third-party services. Google, Cloudflare, and Sefaria are independent third parties; we are not responsible for their services or terms.
